Terms and Conditions for Nautiluxe Photography
Welcome to Nautiluxe Photography. By accessing or using our services, including but not limited to nautical-themed professional photography sessions, maritime event coverage, yacht and boat photo shoots, and marine-inspired portraiture, you agree to comply with and be bound by the following terms and conditions. Please review them carefully.
1. Services Provided
Nautiluxe Photography specializes in professional photography services with a strong focus on nautical and marine themes. Our offerings include, but are not limited to, photography for:
- Nautical-themed sessions
- Maritime events
- Yachts and boats (interior & exterior)
- Marine-inspired portraits
- Underwater photography (where applicable and specified in service agreement)
2. Booking and Payments
All photography services require prior booking and confirmation. A non-refundable deposit may be required to secure your booking, with the remaining balance due as per your specific service agreement. Payment methods and schedules will be outlined in your individual service contract.
3. Cancellations and Rescheduling
Cancellations or rescheduling requests must be submitted in writing. The specific terms regarding deposit refunds, if any, and rescheduling fees will be detailed in your individual service agreement. Nautiluxe Photography reserves the right to cancel or reschedule sessions due to unforeseen circumstances, including but not limited to severe weather conditions or equipment malfunction, in which case a full refund or rescheduling option will be offered.
4. Copyright and Usage Rights
All photographic images produced by Nautiluxe Photography remain the sole intellectual property of Nautiluxe Photography. Clients are granted a limited, non-exclusive license to use the final images for personal or agreed-upon commercial purposes as specified in your contract. Unauthorized reproduction, distribution, or commercial use beyond the agreed terms is strictly prohibited. Nautiluxe Photography reserves the right to use images for portfolio, marketing, and promotional purposes unless explicitly agreed otherwise in writing. Full copyright purchase options may be available upon request and separate negotiation.
5. Client Responsibilities
Clients are responsible for:
- Providing safe and legal access to all locations required for the shoot.
- Ensuring the subject(s) are prepared and available at the agreed-upon time.
- Obtaining any necessary permissions for photography on private property or within restricted areas.
- Adhering to all safety instructions provided by Nautiluxe Photography personnel, especially during water-based or vessel-related shoots.
6. Delivery of Images
Final edited images will be delivered within the timeframe specified in your service agreement, typically via a secure online gallery or digital download. Print services, if ordered, will be fulfilled separately. RAW files are generally not provided unless specifically agreed upon in the contract.
7. Limitation of Liability
Nautiluxe Photography will exercise reasonable care and skill in performing its services. However, Nautiluxe Photography shall not be liable for any loss, damage, or delay to photographic materials, equipment, or for any failure to perform its obligations hereunder due to circumstances beyond its reasonable control, including but not limited to acts of God, war, terrorism, natural disasters, or technical failures.
8. Governing Law
These Terms and Conditions shall be governed by and construed in accordance with the laws of the State of New York, United States of America, without regard to its conflict of law principles.
9. Entire Agreement
These Terms and Conditions, along with any specific service agreement or contract, constitute the entire agreement between you and Nautiluxe Photography regarding our services, superseding all prior and contemporaneous agreements, proposals, or communications.
